1. Acceptance of Terms

By downloading, installing, or using Word Dungeon (“the App”, “the Game”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you (“you”, “your”, “User”) and Word Dungeon (“we”, “us”, “our”). We reserve the right to update these Terms at any time. When we make material changes, we will provide notice within the App. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use Word Dungeon. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Description of Service

Word Dungeon is a word puzzle and dungeon crawler mobile game. The App allows users to:

• Play word-based puzzle rounds to progress through dungeon levels.
• Collect and use in-game power-ups and items.
• Compete on public leaderboards.
• Optionally create an account via Google Sign-In or Apple Sign-In.
• Optionally purchase a Tip subscription via in-app purchase.

The App is available on iOS and may be made available on additional platforms in the future.

4. Accounts

4.1 Guest Access

You may use Word Dungeon without creating an account. Guest progress is stored locally on your device and cannot be recovered if the App is uninstalled or the device is changed.

4.2 Registered Accounts

You may create an account using Google Sign-In or Apple Sign-In. By creating an account, you agree to provide accurate information and to keep your account credentials secure. You are responsible for all activity that occurs under your account. You must notify us immediately if you suspect unauthorized use of your account.

4.3 Display Names

Your display name is publicly visible on leaderboards. You agree not to use display names that are offensive, misleading, impersonate others, or violate any applicable laws. We reserve the right to change or remove display names that violate these Terms without prior notice.

4.4 One Account Per User

Each user may maintain only one registered account. Creating multiple accounts to manipulate leaderboards, circumvent bans, or abuse any feature of the App is prohibited and may result in termination of all associated accounts.

5. In-App Purchases & Subscriptions

5.1 Tip Subscription

Word Dungeon offers an optional “Tip” subscription as an in-app purchase. This is a voluntary support mechanism and does not unlock additional game content or provide competitive advantages.

5.2 Payment Processing

All purchases are processed through the Apple App Store or Google Play Store (collectively, “Platform Stores”). We do not directly collect or store your payment information. All transactions are subject to the payment terms and policies of the respective Platform Store.

5.3 Refunds

Refund requests must be directed to the applicable Platform Store in accordance with their refund policies. We do not process refunds directly.

5.4 Cancellation

You may cancel your subscription at any time through your Platform Store account settings. Cancellation takes effect at the end of the current billing period. Deleting the App or your Word Dungeon account does not automatically cancel active subscriptions — you must cancel through the Platform Store.

5.5 Price Changes

We reserve the right to change subscription pricing. Any price changes will take effect at the start of the next billing period after notice is provided through the Platform Store. Your continued subscription after a price change constitutes acceptance of the new price.

6. Virtual Items & Game Content

6.1 No Real-World Value

All in-game items, power-ups, scores, progress, virtual currencies (if any), and other game content (“Virtual Items”) have no real-world monetary value. Virtual Items cannot be sold, traded, transferred, or exchanged for real money or any item of value outside the App.

6.2 License, Not Ownership

Virtual Items are licensed to you, not sold. We retain all right, title, and interest in and to all Virtual Items. Your license to Virtual Items is limited, revocable, non-transferable, and subject to these Terms.

6.3 No Guarantee of Availability

We may modify, remove, or rebalance Virtual Items at any time for game balance, technical, or other reasons. You are not entitled to compensation for any changes to Virtual Items.

7. User Conduct

You agree not to:

• Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party software to manipulate the Game or gain an unfair advantage.
• Interfere with or disrupt the App, servers, or networks connected to the App.
• Attempt to gain unauthorized access to other users' accounts or data.
• Use the App for any illegal or unauthorized purpose.
• Harass, abuse, or harm other users through display names, leaderboard manipulation, or any other means.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent expressly permitted by applicable law.
• Circumvent, disable, or interfere with security-related features of the App.
• Use the App in any manner that could damage, disable, overburden, or impair our servers or infrastructure.
• Scrape, data-mine, or use automated means to extract data from the App.
• Exploit bugs or glitches in the Game. If you discover a bug, you are encouraged to report it to us.

Violation of these rules may result in suspension or permanent termination of your account without prior notice or refund.

8. Intellectual Property

8.1 Our Rights

All content in Word Dungeon — including but not limited to game design, graphics, artwork, animations, sounds, music, text, code, and the Word Dungeon name and logo — is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to:

• Modify, copy, or distribute the App or any of its content.
• Use the App or its content for commercial purposes, including streaming or content creation for profit without our written permission.
• Create derivative works based on the App.

This license terminates automatically if you violate any provision of these Terms.

8.3 User Content

By setting a display name or any other user-generated content, you grant us a worldwide, royalty-free, non-exclusive license to use, display, and distribute that content within the App (e.g., on leaderboards). You represent that you have the right to grant this license and that your content does not infringe any third-party rights.

8.4 Feedback

Any feedback, suggestions, or ideas you provide about the App are entirely voluntary. We are free to use such feedback without obligation or compensation to you.

9. Leaderboards & Fair Play

Leaderboard rankings are based on your in-game performance. We reserve the right to:

• Remove scores or rankings that we determine were achieved through cheating, exploits, or manipulation.
• Suspend or ban accounts that violate fair play standards.
• Reset leaderboards at our discretion, including for seasonal events or game updates.
• Implement anti-cheat measures and monitoring systems.

Leaderboard positions do not constitute a right or entitlement. We make no guarantees about the accuracy or permanence of leaderboard data.

10. Availability & Modifications

10.1 Service Availability

We strive to keep Word Dungeon available at all times but do not guarantee uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control.

10.2 Modifications

We reserve the right to modify, update, or discontinue any aspect of the App at any time, including game mechanics, features, content, power-ups, and difficulty levels. We are not obligated to provide prior notice of changes, though we will make reasonable efforts to communicate significant changes.

10.3 Discontinuation

We may discontinue the App entirely at our discretion. In such an event, we will make reasonable efforts to provide advance notice. Refunds for unused portions of subscriptions will be handled in accordance with the applicable Platform Store policies and applicable law.

11. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The App will be error-free, uninterrupted, or free of harmful components.
• Game progress or data will be preserved indefinitely.
• The App will be compatible with all devices or operating systems.
• Leaderboard rankings will be accurate or free from manipulation by other users.

Nothing in these Terms excludes or limits warranties or liability that cannot be excluded or limited under applicable law, including mandatory consumer protection laws in your jurisdiction.

12. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of game progress, loss of profits, or loss of goodwill, arising out of or in connection with your use of the App.

Our total liability for any claim arising out of or relating to these Terms or your use of the App shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law. For users in the EEA/UK, this section does not limit liability for damages caused by willful misconduct or gross negligence.

13. Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Word Dungeon and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of the App.
• Your violation of these Terms.
• Your violation of any third-party rights.

This indemnification obligation does not apply to the extent prohibited by the laws of your jurisdiction.

14. Termination

14.1 By You

You may stop using the App at any time. You may delete your account from the Settings screen within the App.

14.2 By Us

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, cheating, abusive behavior, or fraudulent activity.

14.3 Effect of Termination

Upon termination, your right to use the App and all licenses granted under these Terms cease immediately. Sections that by their nature should survive termination will survive, including sections 6 (Virtual Items), 8 (Intellectual Property), 11 (Disclaimers), 12 (Limitation of Liability), 13 (Indemnification), 15 (Governing Law), and this section 14.3.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation within 30 days. If negotiation fails, disputes shall be resolved through the competent courts of Delaware, United States.

Nothing in this section limits your rights under mandatory consumer protection laws of your jurisdiction. EEA/UK users retain the right to bring proceedings in their local courts.

16. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Word Dungeon only, not with Apple Inc. (“Apple”). Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance, support, or warranty services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability, consumer protection, or intellectual property infringement claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right to enforce these Terms against you as a third-party beneficiary.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and you are not on any U.S. Government prohibited or restricted party list.

17. Google Play Store Additional Terms

If you downloaded the App from the Google Play Store, the following additional terms apply:

• These Terms are between you and Word Dungeon only, not with Google LLC (“Google”). Google is not responsible for the App or its content.
• Google has no obligation to provide maintenance, support, or warranty services for the App.
• Google is not responsible for addressing any claims relating to the App.

18. Electronic Communications

By using the App or creating an account, you consent to receive electronic communications from us, including in-app notifications and emails to the address associated with your account. You agree that all notices and communications provided electronically satisfy any legal requirement that such communications be in writing.

19. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, government actions, power failures, internet or telecommunications failures, or cyberattacks.

20. Assignment

We may assign or transfer our rights and obligations under these Terms to any third party without your consent, including in connection with a merger, acquisition, sale of assets, or by operation of law. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

21. Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it at a later time. Any waiver must be in writing and signed by us to be effective.

22. Severability

If any provision of these Terms is found to be unenforceable or invalid by a competent court, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Word Dungeon regarding your use of the App, and supersede any prior agreements or understandings, whether written or oral.
